By accessing or using the East Coast Signatures website (“Site”), placing an order, or submitting items for autograph signings or related services, you agree to be bound by these Terms of Service (“Terms”), along with our Privacy Policy. If you do not agree, do not use our Services.
1. Services Overview
East Coast Signatures (“ECS,” “we,” “us,” or “our”) provides autograph-related services including, but not limited to, private and public signings, send-in autograph services, and the sale of collectible merchandise through our online store powered by Shopify.
All transactions are conducted solely between you and East Coast Signatures.
2. Eligibility & Account Responsibilities

You must be at least 18 years of age or the age of majority in your jurisdiction.

You agree to provide accurate and complete information when placing an order.

You are responsible for maintaining the confidentiality of your account and for all activity conducted under it.

ECS reserves the right to refuse service, cancel orders, suspend, or terminate accounts at its sole discretion and without notice.
3. Orders, Pricing & Payments

All prices are listed in U.S. Dollars unless otherwise stated.

Payment in full is required at checkout.

All signature fees, add-ons, handling fees, and shipping charges are non-refundable except as expressly stated herein.

You are responsible for all applicable taxes, customs duties, brokerage fees, and import charges.

ECS reserves the right to issue refunds, when applicable, as store credit, original payment method, or company check at its sole discretion.
4. Signing Schedules, Delays & Force Majeure
Signing dates and turnaround times are estimates only and subject to change. Signings may be delayed, postponed, or rescheduled due to signer availability, illness, travel issues, professional obligations, venue changes, force majeure events, or circumstances beyond ECS’s control.
If a signing is postponed, all paid orders and submitted items will be held for the rescheduled date.
5. Send-In Autograph Program – Assumption of Risk
By submitting any item to ECS, you assume all risk associated with that item.
ECS, its owners, officers, employees, agents, affiliates, contractors, and participating talent shall not be liable for:

Loss, theft, or disappearance

Damage during shipping, handling, signing, storage, or repackaging

Wear, aging, or deterioration of fragile or vintage items
-
Any indirect, incidental, consequential, special, or punitive damages
Submission of an item constitutes a full and irrevocable release of all claims against the foregoing parties.
6. Item Labeling, Packing & Insurance

Each submitted item must be clearly labeled with your full name and order number.

Improperly labeled items may be marked by ECS in any manner deemed appropriate.

Customers are solely responsible for proper inbound packaging and insurance.

ECS insures outbound shipments only if selected and paid for at checkout.
7. Packaging Materials & Return Method
ECS is not responsible for retaining or reusing customer-supplied packaging unless explicitly selected at checkout.
If ECS-provided packaging is selected, customer packaging materials may be discarded.
Oversized, heavy, or unusually packaged items may incur additional handling or shipping fees.
8. Specialty Items & Oversized Collectibles
Oversized items, boxed collectibles, and Funko POPs may require flattening, disassembly, or special handling.
ECS is not responsible for damage to boxes, plastic windows, inserts, or protective packaging.
Certain items may require prior approval and additional fees.
9. Pen Color, Placement Requests & Add-Ons

Ink color, placement, inscriptions, character names, and quotes are requests only and not guaranteed.

ECS is not responsible for spelling errors, placement variance, ink defects, or marker malfunction.

Signers may alter, limit, or decline requested add-ons at their discretion.
If a separately charged add-on cannot be obtained, only that add-on fee will be refunded after fulfillment.
Attempting to obtain unauthorized add-ons constitutes fraud and may result in order cancellation and account suspension.
10. Offensive Content & Right of Refusal
ECS reserves the right to refuse or cancel any order containing imagery, personalization, or requests deemed offensive, inappropriate, or objectionable by ECS or the signer.
Refunds in such cases will be limited to signature fees only; shipping and processing fees are non-refundable.
11. Signature Imperfections & Subjective Quality
Autographs are provided “as is.” Minor imperfections such as smudging, ink variation, placement differences, or misspellings do not constitute grounds for refunds, replacements, or chargebacks.

Shipping, insurance, and processing fees are non-refundable in all cases.
13. Shipping, Customs & Transfer of Risk

Title and risk of loss transfer to you upon delivery to the carrier.

Shipping timelines are estimates and not guaranteed.

International customers are solely responsible for all duties, taxes, tariffs, and brokerage fees.

ECS is not responsible for refused or abandoned shipments due to unpaid customs charges.
14. Non-Payment, Collections & Enforcement
Unpaid balances may accrue interest at the maximum rate permitted by law.
You agree to pay all costs of collection, including reasonable attorney’s fees.
15. Chargebacks & Fraud Prevention
Initiating a chargeback after participation in a signing or fulfillment of services constitutes a breach of these Terms.
ECS reserves the right to dispute chargebacks, suspend accounts, and pursue legal remedies.
16. Unclaimed Property
Items unclaimed ninety (90) days after ECS’s final delivery attempt become the sole property of ECS and may be sold, donated, or disposed of without compensation.
17. Intellectual Property & Authentication
All Site content, trademarks, logos, and materials are owned by ECS or its licensors.
Authentication methods vary by signing and are disclosed on individual product pages. ECS does not guarantee results from third-party grading or authentication services.
18. Privacy & Shopify Platform Disclosure
ECS respects your privacy. Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
This Site is hosted on the Shopify e-commerce platform. Shopify may collect, store, and process personal information on our behalf for payment processing, order fulfillment, analytics, fraud prevention, and platform functionality.
By using this Site, you acknowledge that:

ECS is not responsible for Shopify’s independent privacy practices

19. Disclaimer of Warranties
ALL SERVICES AND ITEMS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
20. Limitation of Liability
To the maximum extent permitted by law, ECS’s total liability shall not exceed the amount paid for the order giving rise to the claim. ECS shall not be liable for indirect, incidental, consequential, or punitive damages.
21. Indemnification
You agree to indemnify and hold harmless ECS, Shopify, participating talent, and their affiliates from any claim arising from your breach of these Terms or submission of items.
22. Dispute Resolution & Arbitration (New Jersey)
Any dispute arising out of or relating to these Terms or ECS services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.
24. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in effect

Failure to enforce any provision does not constitute a waiver

These Terms constitute the entire agreement between you and ECS

ECS may update these Terms at any time; continued use constitutes acceptance
